Thomas Kay Photography is not responsible for the long-term retention of digital assets provided to clients. It is the client’s sole responsibility to download, back up, and securely store all digital files delivered by Thomas Kay Photography within the designated availability period.
3. Availability of Digital Assets
Photo galleries, video links, and other digital deliverables will be made available to clients for a period of no less than 90 days but no more than 120 days from the date of delivery. During this period, clients are expected to download and securely store their digital assets. After this period, Thomas Kay Photography will remove the digital assets from our servers, and we cannot guarantee their availability.
4. Notification of Availability Period
Clients will be notified via email when their digital assets are ready for viewing and download. The email will include the specific availability period and instructions for accessing and downloading the files.
5. Backup Recommendations
We strongly recommend that clients back up their digital assets to multiple storage locations, such as external hard drives, cloud storage services, or other reliable backup solutions, immediately upon receipt.
6. Extended Availability and Additional Services
Should clients require an extended availability period or additional copies of their digital assets after the initial availability period has expired, Thomas Kay Photography may offer such services at an additional cost, subject to our discretion and the availability of the original files.
7. Disclaimer
Thomas Kay Photography will take reasonable measures to ensure the security and integrity of digital assets during the initial availability period. However, we do not guarantee against data loss, corruption, or other issues beyond our control.

2. Creative Control
Thomas Kay Photography retains full creative control over all aspects of the photography and videography process, including but not limited to composition, lighting, styling, and posing. Our professional judgment and artistic vision guide the creation of all digital assets, ensuring the highest quality and most visually appealing results.
3. Final Editing Rendition
The final editing and rendition of all photographs and videos are at the sole discretion of Thomas Kay Photography. This includes decisions related to color correction, cropping, retouching, and any other post-processing techniques deemed necessary to achieve the desired artistic outcome.
4. Client Preferences and Input
While we value client input and preferences, Thomas Kay Photography reserves the right to make all final decisions regarding the creative and editing process. Clients are encouraged to share their vision and specific requests prior to the shoot, but the final interpretation and presentation of the digital assets will be determined by Thomas Kay Photography.
5. Revisions and Adjustments
Minor adjustments to the final edited images or videos may be requested by the client within a specified period after delivery. Such adjustments will be considered at the discretion of Thomas Kay Photography and may incur additional fees. Major revisions or re-edits that significantly alter the original artistic vision will not be entertained.
6. Artistic Integrity
Thomas Kay Photography is committed to maintaining the integrity and authenticity of our artistic work. As such, we do not provide raw or unedited files to clients. The final edited images and videos represent our professional standards and artistic style, ensuring a consistent and high-quality portfolio.
7. Agreement to Policy Terms
By engaging Thomas Kay Photography for photography and videography services, clients acknowledge that they have read, understood, and agreed to the terms of this Creative Control and Final Editing Policy.
1. Retainer Fee
To secure your photo session booking with Thomas Kay Photography, a non-refundable retainer fee is required. This fee reserves the date and time exclusively for you and covers the photographer’s time and preparation for the session.
2. Cancellation Policy
If you need to cancel or reschedule your photo session, please notify us at least 7 days in advance. Failure to provide sufficient notice may result in the forfeiture of your retainer fee.
3. No-Show Policy
If you fail to appear for your scheduled photo session without prior notification, you will be considered a no-show. The photographer will wait for a maximum of 15 minutes from the scheduled start time. After this grace period, the session will be deemed canceled, and the retainer fee will be forfeited.
4. Late Arrivals
If you arrive late for your photo session, the session will still end at the scheduled time. The photographer may not be able to accommodate extra time due to other scheduled appointments.
5. Client Responsibilities
It is the client’s responsibility to arrive on time for the scheduled session and to notify the photographer promptly of any changes or cancellations. Failure to do so may result in the forfeiture of the retainer fee.
6. Exceptions
In exceptional circumstances, such as severe weather conditions or sudden emergencies, we may consider waiving the retainer fee forfeiture. However, such exceptions are at the discretion of the photographer.
1. Physical Photography Products
We offer a 30-day refund policy for all physical photography products purchased directly from our website. Custom products such as custom ordered prints that were customer selected images are NOT eligible for refund for any reason. If you are not satisfied with your purchase for any reason, please contact our customer support team within 30 days of receiving your order to initiate a return and refund process. To be eligible for a refund, the photography product must be unused and in the same condition that you received it. We reserve the right to refuse refunds for items that do not meet these criteria.
2. Digital Photography Products
Refunds are not available for digital photography products, including but not limited to digital prints, photo editing presets, and online photography courses. Due to the nature of digital goods, all sales are final. Refunds will not be granted in cases where the customer is unable to download the product due to technical issues on their end, such as internet connectivity problems or incompatible devices. Additionally, refunds will not be granted based on dissatisfaction with the artistic style of the final product. Our photography products are offered with clear descriptions and examples of our artistic style, and customers are encouraged to review these before making a purchase. As with digital photography products, refunds will not be granted due to the customer’s inability to download the product or dissatisfaction with the artistic style of the final product. Our video products are presented with clear descriptions and examples of our artistic style, and customers are encouraged to review these before making a purchase.
